The Measure of Administrative Proporcionality

Abstract

The comfort offered by the principle of proportionality in rationalising a reasoned decision can often be illusory given its limitations, internal as well as external, arising from the lack of elements that would allow its correct application or the limitations of legal training in its use. The aim of this text is to analyse the challenges posed by the administrative implementation of the principle of proportionality, especially regarding the (critical) suggestions of the economic analysis of the measure of the proportionality.
